Terms
The terms,
in plain English.
This page covers using this website, and summarises what the service is. If you become a client, the agreement you sign is the document that governs the work — where the two differ, the agreement wins.
Who you are dealing with
Fitz Web Dev is the trading name of Frugal Fitz Designs LLC, based in St. George, Utah. It is one person: Alex Fitz. The LLC is the party on every contract.
Using this website
Read it, share it, send it to whoever you like. Do not use it for anything unlawful, do not try to damage or overload it, and do not scrape or harvest content, images or contact details from it, by hand or with a tool.
This page is a summary, not the contract
The prices and terms described here are current and kept accurate. They are not the agreement, and nothing on this website creates a contract on its own — the subscription and the agreement do that.
What it costs
$50 a month. No setup fee, no deposit and no contract. Cancel any time; billing stops at the end of the month already paid for. The price is per website — two businesses means two subscriptions, and there is no bundle rate. An ordinary domain is included and renewed; a premium or resale name is not, and would be quoted before anything is bought.
What is not promised
No guarantee of search rankings, traffic, phone calls, leads or revenue. Nobody can honestly promise those and anyone who does is guessing. No guarantee that hosting never goes down — it runs on outside infrastructure. No guarantee that a site behaves identically in every browser, device and assistive technology, now or later.
Work that is not in the $50
Online stores, booking systems wired into your own software, custom software or apps, ad management, a logo designed from scratch and photography are all things I do. They are not part of a $50 website, so each one gets its own number, and nothing starts until you have seen it and agreed.
Other companies’ names and logos
The websites, names, logos and photographs shown on this site belong to the businesses that own them, not to me. They are here to show work I have done. Showing a name or a logo does not mean that company endorses me, sponsors me, or is connected to me beyond the work described. If you own one of these marks and want it taken down, text or email me and it comes down.
What is mine
The design, layout, code and wording of this site are mine. A site I build for a client is licensed to them for as long as they are subscribed, which the agreement sets out in full.
Availability
This site is provided as it is. I do not promise it will always be available, error-free or fully up to date, and I may change or remove any part of it at any time.
Liability
To the fullest extent the law allows, nothing is owed for indirect or consequential loss arising from using this website. For clients, the limit set out in the agreement is the one that applies to the service.
Which law applies
Utah law. Any dispute belongs in the state or federal courts serving Washington County, Utah.
Changes
These terms can change. The date at the bottom of the page changes with them, and for clients the agreement sets out its own notice period.
